AI in the Courtroom

Yes, it’s about time that artificial intelligence get its way before the court. The article linked below discusses over 1,300 cases in which AI has been involved in court proceedings. The problem, of course, is that these 1,300 cases are just the tip of the iceberg, as courts are increasingly having to deal with legal briefs containing AI-generated errors in an ever-growing number of legal disputes. Heise.de describes the problem as follows: AI applications cite nonexistent court rulings, distort statements, or misrepresent judgments. This is particularly problematic for Anglo-American case law, which relies heavily on precedents.

Fortunately, Damien Charlotin, a legal scholar at HEC Paris, has now created an online database that tracks cases worldwide in which courts have sanctioned individuals for submitting documents containing AI errors. Of the 1,300 cases, 800 were heard in U.S. courts. Some U.S. courts have now introduced a labeling requirement for documents created using AI. However, there is not yet a national regulation for this.
