Lawsuit for our Future Expanded
Just under a year ago, activists from Aktion Freiheit statt Angst e.V. also co-signed the Greenpeace climate lawsuit against the federal government. A hearing before the Federal Constitutional Court (BVerfG) in Karlsruhe has not yet taken place. However, following the federal government’s latest climate-damaging measures, our lawyers were able to add a few more arguments to the case. They wrote to the plaintiffs: The climate protection program is insufficient — measured against the goals of the Climate Protection Act (KSG) and the requirements of the Constitution. The Expert Council on Climate Issues confirmed this in its report dated March 25, 2026. In May, the Expert Council issued another statement, making it clear that, based on current projection data, the 2030 and 2040 climate targets will not be met. Furthermore, the back-and-forth over amending the so-called “Heating Act” (actually: Building Energy Act, GEG) and the so-called Building Modernization Act (GModG) are measures that tend to weaken climate protection rather than improve it. Meanwhile, the German Environmental Aid Association (DUH) is also considering filing its own constitutional complaint against the current Climate Protection Act. As of now, there is an expert opinion here that the lawyers wrote for Greenpeace, and here is an analysis on whether tenants can challenge a cost allocation if their landlord installs gas heating.
