No more substitute prison sentences!

We have repeatedly advocated for the abolition of the “substitute prison sentences” (265a StGB) introduced under the Nazis, such as those for fare evasion ( https://www.a-fsa.de/de/articles/8116-20220818-fuer-die-abschaffung-von-ersatzfreiheitsstrafen.html and https://www.a-fsa.de/de/articles/9143-20250504-ersatzfreiheitsstrafe-endlich-abschaffen.html ). The current “increased transportation fee” of €60 should serve as a sufficient warning. Even drivers get away with a fine when parking on the sidewalk or in a no-stopping zone. Yet thousands of people with little money end up in our prisons every year — and each one costs taxpayers many hundreds of euros per day.

Campact had campaigned for decriminalization via a petition on the WeAct platform. Over 121,000 people have now signed it. Justice Minister Stefanie Hubig (SPD) has also responded and is publicly calling for the decriminalization of fare evasion. However, opposition has immediately emerged from the CDU. Günter Krings, the Union’s spokesperson on legal policy, claims that this would lead to an increase in fare evasion. The city of Cologne has already proven the opposite with its regulations or support Mrs Hubig with a mail.

Campact is therefore calling on people to point out Mr. Krings’ false claims by sending an email to guenter.krings@bundestag.de. Of course, it is also possible to continue signing the petition linked below.
